The State of New York against Kevin McCallister

The following is the State of New York’s charges against Chicago, Illinois resident Kevin McCallister. The charges are assault & battery in the 1st, and the attempted murder of Harry Lyme and Marvin Merchants on the night of December 24th, 1992. Additional charges include: breaking & entering and destruction of property at the residence of Rob McCallister, credit card theft, credit card fraud, boarding a flight without a proper boarding pass, and false impersonation.

Exhibit A

The defendant is alleged to have committed the following acts against Marvin Merchants, also known as Marv:

-Three bricks dropped from an estimated height of 30 feet on his cranium.

-Construction grade staples shot into nose, buttocks, and genitals.

-Poured a shelf full of paint on to him.

-Caused a fall of two stories onto concrete causing victim to land on his arms

-Electrocuted.

-Bag of concrete dropped on top of skull.

-Hit in face with metal bar, twice.

-Smushed by tool chest.

-Burned by kerosine soaked rope and fell 3 stoies onto concrete, then more paint dropped on him. All while trying to escape the attacks.

-Attacked by pigeons.

The defendant is alleged to have committed the following acts against Harry Lyme:

-Caused him to fall on concrete from a height of 20 feet against making a fire escape ladder unsafe for public use.

-Numerous wrenches dropped on his skull.

-Head set on fire.

-Explosion due to toilet filled with kerosine.

-Fall from ladder that was unsafe due to the defendant weakening it with a saw.

-Hit in the face with a metal bar, twice.

-Burned by kerosine soaked rope and fell 3 stoies onto concrete, then more paint dropped on him. All while trying to escape the attacks.

-Attacked by pigeons.

Additionally, the defendant appeared to show no remorse in his actions. He appeared celebratory and at one point is alleged to have taunted the victims saying, “nice night for a neck injury.”
